APPEALS PROCEDURE

Students wishing to dispute a decision by one of the Regents Centers for Learning Disorders (RCLDs) with regard to eligibility for accommodations may appeal by submitting a request for independent review of their documentation by the directors of the other two RCLDs.

The request must be:

Upon notification of the appeal by the DSP, the director of the RCLD [whose decision is being disputed] will provide copies of the documentation to the other two directors. The remaining two directors will conduct independent reviews according to established Board of Regents (BOR) criteria for reviewing outside documentation.

In the event that consensus is not reached between the two "reviewing" directors, the initial director's decision will be considered to provide a majority consensus. A final decision will be based on agreement between at least two of the three directors.

The review team (made up of the two independently reviewing directors) will notify the student in writing of their decision, with a copy to the initiating director.
